MindKind Therapies (“we”, “us”, “our”) provide affordable, accessible and specialist therapeutic services for adolescents, adults and couples. We also promote MindKind Day, an annual event to raise mental health awareness that contributes to MindKind Therapies providing services and support to those less financially fortunate. 


We are committed to protecting your personal data and respecting your privacy in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

This privacy policy (“Privacy Policy”) and any other documents referred to in it, sets out the basis on which we collect and process your personal data as a data controller when you use our services (“Services”) and/or our website (mindkindtherapies.com), (“Site”) and other interactions with us through other means such as clinical assessors, therapists, advisors or stakeholders of MindKindTherapies while discussing or contracting one of our professional services or at direct conversations and events.

By using or accessing MindKind Therapies’ Site or the Service and providing us with your personal data, you are accepting the practices described in this Privacy Policy, and you are consenting to our processing of your personal data as set forth in this Privacy Policy.


Who is responsible for the processing of your personal data?
The General Data Protection Regulation (GDPR) defines a ‘data controller’ as the person in an organisation who: ‘determines the purposes and means of processing personal data’. Why is your personal information required?
Under a legitimate interest, data privacy law allows us to collect your personal information in order to understand your needs and to provide you with a professional service. In certain circumstances, we may also collect your personal information in order to fulfil our ethical and contractual obligations with you and where we may be required by law.


Should you decide to not share your personal information with us, or refuse certain contact permissions, we may not be able to provide the services requested.


How your data is collected
When you contact us whether directly or indirectly, with an enquiry about our counselling, psychotherapy or placement services; or to donate or purchase sales from our store, we will collect information to help us satisfy your enquiry and to meet your requirements. This will include:

 

  • Initial & Transaction Data: Your full name, email, username, telephone number, and a brief outline of your enquiry reason; together where relevant any payment card details, address for the initial assessment charge, or for donations provided or purchased from us. Should you decide not to proceed, we will ensure all your personal data is archived and deleted within 7 seven years. If you would like us to delete this information sooner, please contact letstalk@mindkindtherapies.com expressing your wishes.

  • Technical Data. Internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this Site or the Services.

  • Profile Data: Your username and password, purchases made by you, your interest, preferences, feedback and survey responses. Should you/we decide after your initial assessment appointment to proceed with therapy, further data will be requested including, but not limited to, your GP details, address, DOB, emergency contact,

  • Usage Data: includes information about how you use our Site and Services, including the full Uniform Resource Locators (URL) clickstream to, through and from our Site and Services (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.

  • Marketing and Communications Data: includes your preferences in receiving marketing from us and our third parties and your communication preferences.

  • Aggregated Data: We also collect, use and share statistical or demographic data for any purpose. This Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Privacy Policy.

  • Direct Interactions. You may give us your Identity, Contact and Financial Data when you fill in forms or correspond with us by post, phone, email or otherwise. This includes personal data you provide when you register to use our Site or to receive our newsletter, subscribe to use our Services, create an account to use our Site or Services, request marketing to be sent to you, search for a product or place an order on our Site, participate in discussion boards or other social media functions on our Site, enter a competition, promotion or survey, attend a conference or webinar, give us feedback or contact us and when you report a problem with our Site or Services.

  • Purchases: If you make purchases via our Site or within any Services, or register for an event or webinar, we may require you to provide your Identity, Contact, Financial and Transaction Data.

  • Automated Technologies or Interactions: As you interact with our Services, Sites or emails, we automatically collect Technical Information about your device, browsing actions, patterns, Location Data and Usage Data. We collect this personal data by using cookies, server logs, web beacons, pixels, and similar technologies about your device, and your use of our Site and Services. We may also receive Technical Data and Location Data about you if you visit other websites employment our cookies. Please see the Cookie section below for further details.

 

Our Site may automatically collect details about your visit, including: IP address, the website from which you linked from, search engine, pages on www.mindkindtherapies.com that you visit, and other analytical data such as date, time and duration of your website visit.
 

This information is only processed in a way that does not identify anyone. We do not make, and it does not allow any third-party supplier to make any attempt to find out the identities of those visiting our Site.
 

We use legitimate interests as our lawful basis for holding and using your personal information in this way when you visit our Site; and so that we can continually improve our Service to you. No user-specific data is collected by MindKind Therapies or a third party if you fill in a form on our Site; and such data will be temporarily stored on the web host before being sent MindKind Therapies.
 

Google analytics only collect non-identifiable data which means they cannot identify who is visiting.
 

While you are accessing counselling and data security.
Everything you discuss within therapy services by MindKind Therapies is confidential. That confidentiality will only be broken if at any time it is felt you are at risk of harm to yourself or to/from others; and we will always try to speak to you about this first, unless there are safeguarding issues that prevent this undertaking.

 

We will keep a record of your personal details and any forms you complete to help the counselling services run smoothly. These details, including brief written notes of each session are kept securely via encryption within MindKind Therapies’ dedicated GDPR compliant portal, The portal is accessed only via secure password with strict permissions keeping patient data safe and meeting EU privacy standards. The portal uses 2048-bit SSL encryption, role-based access, and high-security data, stored on UK servers with real-time monitoring, bank-level encryption and secure data centres to block threats.

Any Sensitive personal data, NHS numbers and National insurance numbers, are treated as highly confidential by default, and always transmitted and stored in a strongly encrypted/anonymised form. Good faith efforts are made to securely store all personal data. The relevant data is only accessible to limited staff members in so far as access is necessary to enable them to perform their duties and guarantee the correct working of the Site or Services.

Your data is not shared with any third party unless requested by your GP, an alternative health or welfare authority or a legal authority; where your consent will be requested in advance where possible. If there is relevant information contained either within a text or email message these also will be kept encrypted or deleted either immediately or after counselling ends if it is not important.

 

During our work together, therapists working directly for MindKind Therapies will record brief notes of what you have talked about during each session. This may contain other personal data you share such as marital status, children, gender, occupation and ‘special category data’ such as mental and physical health details, race, ethnic origin, politics, religion, sex life or sexual orientation. ‘Special category data’ is defined by the GDPR as being information that is more sensitive than other personal information. The condition of the GDPR that we apply to the processing of your special category information is that it is ‘pursuant to contract with a health professional’. This means that, if you begin counselling, then we will likely need to process some special category information about you. Usually, this is information about your mental health, and we need to process it in order to fulfil our contractual obligations to you in delivering a safe, effective service. If you are referred to or chosen a private therapist through MindKind Therapies, their records sit outside of our database; so please check their individual privacy policy.
 

After counselling has ended.
Once counselling has ended your records will be kept for up to seven years from the end of our contact and are then securely destroyed. If you want to delete your personal information sooner than this, please formally request this in writing via letstalk@mindkindtherapies.com.  


Third party recipients of personal data.
We sometimes share personal data with third parties, for example, where we have contracted with a supplier to carry out specific tasks. In such cases we have carefully selected which partners we work with. We take great care to ensure that we have a contract with the third party that state what they are allowed to do with the data we share with them. They do not use your information in any way other than the task for which they have been contracted. This may include Microsoft Office/ Proton for email and safe cloud storage, Zoom, Communications Inc. for online sessions, our CRM portal, Wix.com Ltd for website server hosting and processing of online booking sessions, analytics providers like Google, payment provider Stripe and/or your GP or any other health professional and insurance provider.


Your rights
MindKindTherapies try to be as open as we can be in terms of giving people access to their personal information. You have a right to ask to delete your personal information, to limit how we use your personal information, or to stop processing your personal information. You also have a right to ask for a copy of any information held about you and to object to the use of your personal data in some circumstances. You have the right to ask us to provide a copy of the information held in my records. You also have the right to have any inaccuracies in your information corrected. You may withdraw your consent to hold and process your data at any time. However, if you do this while actively receiving therapy, your therapeutic services would have to end.
 

To make a request for any personal information we may hold about you, please formally request this in writing to letstalk@mindkindtherapies.com. If you have any complaint about how we handle your personal data please do not hesitate to get in touch with us by writing or emailing to the contact details given above. We welcome any suggestions for improving my data protection procedures.
 

If you want to make a formal complaint about the way we have processed your personal information we ask you contact us initially, and should your complaint not be resolved or you remain unsatisfied, you can contact the ICO which is the statutory body that oversees data protection law in the UK. Confidentiality:
The content of all sessions is kept in the strictest confidence, including all records and notes. However, some situations could result in disclosure being:

  • If you are considered to be at serious risk to yourself or to other people, then further professional advice could be beneficial and your assigned therapist would have to disclose this information to your GP.

  • Any illegal activities and acts of terrorism, where not to disclose would break the law.

  • Any safeguarding or child protection issues where a child could be at risk of harm or neglect must be reported to the appropriate authorities as required by The Children Act 1989.


MindKindTherapies, our therapists and stakeholders would always aim to discuss this with you before taking any action, unless it is considered that the urgency of the situation requires immediate action to safeguard the physical safety of yourself or others.
 

MindKind Therapies and our therapists adhere to BACP (British Association of Counselling and Psychotherapy) framework (2018) to ensure high quality operational and ethical practice. This includes attendance to monthly supervision. All supervisors also adhere to continuality regulation and your personal data is not shared, besides your first name to protect your identity.
